1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

2. Scope of Services

2.1 The Company provides rubbish and waste collection services within its defined service area. Availability of the Services may vary and is subject to operational capacity, access, and compliance with applicable law.

2.2 The Company reserves the right to refuse to collect certain items, including but not limited to hazardous waste, clinical or medical waste, asbestos, chemicals, flammable or explosive materials, gas bottles, tyres, and any other items that the Company reasonably considers unsafe, illegal, or unsuitable for collection.

2.3 The Customer is responsible for informing the Company in advance of any unusual, oversized, heavy, or potentially dangerous items to be collected. Additional charges may apply for such items or for work that is more extensive than reasonably anticipated at the time of booking.

3. Booking Process

3.1 Bookings for Services may be made by telephone, email, or through any other method made available by the Company from time to time.

3.2 When making a booking, the Customer must provide accurate information, including the Site address, contact details, description and approximate volume or weight of the Waste, access details, and any relevant timing requirements.

3.3 Any quotation provided prior to attendance is based on the information supplied by the Customer. If on arrival the Waste is significantly different in type, volume, accessibility, or location, the Company may amend the quotation, charge additional fees, or decline to carry out all or part of the Services.

3.4 A booking is considered accepted when the Company confirms the booking, allocates a collection slot, and, where required, receives any applicable deposit or payment details.

3.5 The Customer must ensure someone authorised is present at the Site at the agreed time to grant access, confirm the Waste to be removed, and approve any additional charges where applicable.

4. Access and Site Conditions

4.1 The Customer must ensure safe, reasonable and clear access to the Site and to the Waste for the Company’s staff and vehicles. This includes arranging parking, entry codes, gate access, and any permits if required.

4.2 If the Company is unable to gain access to the Site, or if access is unsafe or obstructed, the Company may charge a wasted journey fee or re-book the Service at an additional cost.

4.3 The Customer must ensure that the Site is safe and that all necessary precautions are taken to protect people and property during the provision of the Services.

5. Pricing and Quotations

5.1 Prices are typically based on the volume and type of Waste removed, the time required to carry out the work, labour involved, and any additional services requested.

5.2 Any quotations provided prior to collection are estimates only and may be revised after an on-site assessment. The final price will be confirmed with the Customer before the Service is carried out.

5.3 All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes where required by law.

5.4 The Company reserves the right to adjust its prices from time to time. The applicable price will be that agreed at the time of booking or as revised and agreed on-site before the Service is performed.

6. Payments

6.1 Payment terms will be confirmed at the time of booking. Unless otherwise agreed in writing, payment is due in full on completion of the Services.

6.2 The Company may accept payment by cash, debit or credit card, bank transfer, or other methods as communicated to the Customer.

6.3 For account customers or commercial clients, payment terms may be agreed separately and confirmed in writing. In the absence of such agreement, payment is due on completion of the Services.

6.4 If payment is not made on the due date, the Company reserves the right to charge interest on any overdue amount at the statutory rate, and to recover any reasonable costs incurred in pursuing payment, including legal and debt recovery costs.

6.5 The Customer shall not be entitled to withhold, set off or deduct any amount from the price owed to the Company, except where required by law or expressly agreed in writing by the Company.

7. Cancellations, Changes and Missed Appointments

7.1 The Customer may cancel or amend a booking by giving reasonable notice to the Company.

7.2 Where the Customer cancels a booking with more than 24 hours’ notice before the scheduled collection time, no cancellation fee will normally apply, unless a non-refundable deposit has been agreed for specific Services.

7.3 Where the Customer cancels with less than 24 hours’ notice, the Company may charge a cancellation fee, which may be up to a reasonable proportion of the agreed price to cover administrative and scheduling costs.

7.4 If the Customer fails to be present at the Site at the agreed time, or if the Company cannot gain access or safely carry out the work due to reasons within the Customer’s control, the Company may charge a missed appointment or wasted journey fee.

7.5 The Company reserves the right to cancel or reschedule a booking due to unforeseen circumstances, including but not limited to vehicle breakdowns, staff illness, extreme weather conditions, or safety concerns. In such cases, the Company will endeavour to notify the Customer as soon as reasonably practicable and arrange an alternative appointment.

8. Customer Responsibilities

8.1 The Customer is responsible for ensuring that all Waste presented for collection is lawful, non-hazardous (unless otherwise agreed and legally permitted), and accurately described to the Company.

8.2 The Customer must separate or identify any items that are not to be removed. The Company will not be responsible for the removal of items that were not clearly identified or segregated.

8.3 The Customer must not include in the Waste any items that are prohibited by law or by these Terms and Conditions. If such items are discovered, the Company may refuse to remove them, charge additional fees, or require the Customer to arrange lawful disposal at their own cost.

8.4 The Customer is responsible for any necessary permissions, consents or authorisations relating to the collection and removal of the Waste from the Site, including where the Site is a managed building or shared area.

9. Waste Handling and Environmental Compliance

9.1 The Company will handle, transport and dispose of Waste in accordance with applicable UK waste management legislation, including the duty of care in relation to controlled waste, and any relevant environmental regulations.

9.2 Where required, Waste will be transferred to licensed facilities for sorting, recycling, recovery or disposal. The Company will use reasonable efforts to minimise landfill and encourage recycling where practicable.

9.3 The Customer acknowledges that once the Waste has been collected and loaded onto the Company’s vehicle, ownership and responsibility for that Waste will normally transfer to the Company, subject to compliance with relevant laws and these Terms and Conditions.

9.4 The Customer agrees to provide any information reasonably requested by the Company to ensure compliant handling, transport and disposal of the Waste.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

10.2 Subject to clause 10.1, the Company’s total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence, breach of statutory duty or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Services giving rise to the claim.

10.3 The Company shall not be liable for any indirect or consequential losses, including loss of profit, business interruption, loss of opportunity, or loss of data.

10.4 The Customer is responsible for removing or securing any valuable, fragile or sentimental items before the Services commence. The Company will take reasonable care when carrying out the work but shall not be liable for minor cosmetic damage or wear and tear that is reasonably incidental to the movement or removal of Waste.

10.5 If the Customer believes that the Company has caused damage to property, the Customer must notify the Company as soon as reasonably practicable and in any event within 48 hours of becoming aware of the damage, providing reasonable details and evidence to support the claim.

11. Insurance

11.1 The Company will maintain appropriate public liability insurance and, where applicable, employer’s liability insurance in connection with the provision of the Services.

11.2 Copies of insurance details may be made available to the Customer on reasonable request.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue.

12.2 The Company will investigate complaints promptly and aim to resolve them fairly and reasonably. The Customer agrees to cooperate with any such investigation.

12.3 If a dispute cannot be resolved directly between the parties, either party may seek to resolve the matter through negotiation or, where appropriate, through mediation or the courts of England and Wales.

13. Force Majeure

13.1 The Company shall not be liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to extreme weather, natural disasters, strikes, lock-outs, accidents, traffic disruptions, or actions of local authorities.

13.2 In such circumstances, the Company will use reasonable endeavours to resume the Services as soon as reasonably practicable.

14. Data Protection and Privacy

14.1 The Company may collect and process personal data relating to the Customer for the purposes of managing bookings, providing Services, processing payments, handling queries and complying with legal obligations.

14.2 The Company will handle personal data in accordance with applicable UK data protection laws and only retain such data for as long as is reasonably necessary for the purposes for which it is collected.

15. Variations to Terms

15.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any revised terms will take effect when published or when notified to the Customer, and will apply to bookings made after that date.

15.2 The version of the Terms and Conditions applicable to a particular booking will be the version in force at the time the booking is confirmed.

16. Severability

16.1 If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted.

16.2 Any modification or deletion under clause 16.1 shall not affect the validity and enforceability of the rest of these Terms and Conditions.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.
